Guidance For Applicants and Licence Holders on Responsibility Managing Noise Nuisance from Licensed Premises

This guidance document is intended to help licensees and those applying for Licenses on the management of noise and other public nuisance issues from their premises and has been prepared and adopted by Environmental Health Departments of all the 14 Essex Local Authorities. The Environmental Health Department generally comments on the Licensing objective for the prevention of public nuisance aspect of your application and if you have not addressed these matters by statements or information on or accompanying your application form, they may make representation (an objection) to the Licensing team or call for a review of an existing licence. This may affect your application or licence and may result in a Licensing Hearing to consider the objection. The document is also intended to provide guidance on best practice for preventing noise nuisance in general from similar premises other than licensed ones.

The Act covers a number of licensable activities including the sale and supply of alcohol, provisions of regulated entertainment and provision of late night refreshments (hot food or drink between the hours of 11pm and 5am).  Licences are required for the following types of premises or events:

  • Pubs
  • Nightclubs
  • Restaurants
  • Takeaways including mobile vans that provide hot food/drink after 11pm
  • Social and Private Members Clubs
  • Cinemas and Theatres
  • Off Licences
  • Hotels, Guest Houses and Holiday Parks
  • Indoor Sporting Events
  • Musical Entertainment (Live and Recorded Music)
  • Occasional Events where alcohol and/or entertainment is provided.

Licensing Policy 2022-2027

"Guidance to prevent illegal working in licensed premises". From 6 April 2017, the Licensing Authority has a legal obligation to prevent persons from applying for and being granted Personal Licences or Premises Licences when they do not have the right or entitlement to work in the UK. In other words the person/applicant does not hold the correct immigration status to work in the UK, or has only a time limited status to work in the UK. The guidance shown on the link has been sent out to Licensing Authorities from the Home Office, but clearly defines for applicants what documents they will be asked to produce by the Licensing Authority when submitting an application for a Personal Licence or Premises Licence under the Licensing Act 2003. In particular you are advised to look at the documents shown in annex A on page 17 of the document above as you will be asked to produce a copy or scanned copy of one of these documents to support your right to work in the UK and in order for the Licensing Authority to be able to process and grant your application. We will not and cannot process or grant an application for a Personal Licence or Premises Licence without all of the relevant and necessary documentation being in place and in accordance with the documentation shown on Annex A page 17 of the document above.

Temporary Event Notice

Please note that currently all Temporary Event Notices are also subject to COVID requirements and restrictions. You may also be asked to speak with the Safety advisory group regarding your event.

The fee is not refundable if the notice is withdrawn or cancelled, is made too late, or if a statutory limit is exceeded. 

Please note: a temporary event notice cannot be changed once acknowledged by the licensing authority. If your event does not go ahead as planned you can cancel the TEN at any time up to 24 hours before the TEN start time and the TEN will not count towards your total yearly allowance. However, your application fee cannot be refunded.

Applications for Temporary Event Notices are usually dealt with within 10 working days of receipt of a full application.  In very exceptional circumstances the deadline may be required to be extended, you will be notified of the new deadline and the reason for extending it.

Will Tacit Consent Apply?

Yes. This means that you will be able to act as though your application is granted if you have not heard from the local authority by the end of the target completion period.

Change of Designated Premises Supervisor

Change of Designated Premises Supervisor application forms can be submitted by email to licensingsection@tendringdc.gov.uk. Payment will then be taken once your application has been received by email and circulated to the relevant responsible authorities. This will then be processed in accordance with the Licensing Act 2003.

Applications for change of Designated Premises Supervisor are usually dealt with within 25 days of receipt of a full application.  In very exceptional circumstances the deadline may be required to be extended, you will be notified of the new deadline and the reason for extending it.

Yes. This means that you will be able to act as though your application is granted if you have not heard from the local authority by the end of the target completion period.

Minor Variations of Premises Licence

Regulations under the Licensing Act 2003 to bring in a new minor variations procedure were laid before parliament on 8 July 2009.  The new procedures came into force on 29 July 2009.  The regulations allow minor variations to be made to licensed premises instead of premises licence holders having to go through the cumbersome full application process by introducing new sections into the Act.

Applications must be advertised on the premises on a white public notice and the standard application form will be set out in the regulations.

Interested parties in the vicinity of the application also have ten working days from the date the application was received to make representations on the likely effect of the variation on the licensing objectives.  There is no right to a hearing but the licensing officer must take any relevant representations into account.

The licensing authority has to wait at least eleven working days before deciding whether to grant the minor variation or refuse the application - and must make its decision within fifteen working days of having received the application.  If it fails to make a decision in that time, the application is deemed to have been refused and the application fee will be returned unless the licensing authority and the applicant agree it can be treated as a new application.

Minor variations generally fall into four categories:

  • minor changes to the structure or layout of a premises
  • small adjustments to licensing hours
  • the removal of out of date, irrelevant or unenforceable conditions or addition of volunteered conditions and
  • the addition of certain licensable activities.

Immigration, Asylum & Nationality Act 2006

To comply with the Immigration, Asylum & Nationality Act 2006 this Council is required to check your eligibility to live and work in the UK. You will be required to confirm that you are able to live and work in the UK and that on request, you will be able to provide evidence of this.
